Privacy Policy
1. Scope and Who We Are
This Privacy Policy explains how Viper Digital LLC, a New Jersey limited liability company doing business as Viper Digital (“Viper Digital,” “we,” “us,” or “our”), collects, uses, discloses, retains, and protects personal information in connection with our corporate website, sales process, client onboarding, managed website and digital-growth services, support, communications, and other business operations that link to this Policy.
This Policy applies when Viper Digital determines why and how personal information is used for its own business purposes. It does not replace the privacy policy of a Viper Digital client. When we process information from or through a client website solely to provide contracted services on that client’s instructions, the client generally determines the purposes of processing and its privacy policy governs the relationship with its website visitors, leads, customers, and personnel. Requests concerning information submitted to a client website should ordinarily be directed to that client.
This Policy does not apply to third-party websites, platforms, applications, or services that have their own privacy notices.
2. Information We Collect
Depending on how a person interacts with us, we may collect the following categories of personal information.
Contact and identity information may include name, business name, job title, mailing address, email address, telephone number, username, account identifier, signature, and preferred communication method.
Commercial and relationship information may include requested services, proposals, contracts, order and subscription information, transaction history, billing status, client preferences, project instructions, service history, support records, and information about a person’s relationship with an organization.
Billing information may include billing address, transaction identifiers, payment status, partial payment-card details, and information supplied to our payment processor. Viper Digital should not directly store full payment-card numbers or card-security codes unless a separately approved compliant system is implemented.
Website and device information may include Internet Protocol address, device and browser type, operating system, language, referring and exit pages, pages viewed, links selected, approximate location derived from an IP address, timestamps, session information, cookie identifiers, advertising identifiers, and diagnostic or security logs.
Communications information may include emails, support requests, meeting notes, call information, form submissions, feedback, reviews, survey responses, and other content a person chooses to provide. If calls are recorded, Viper Digital must provide any notice or consent required by applicable law and accurately disclose the practice here.
Project and account-access information may include brand assets, website content, domain and DNS details, account identifiers, authorized-user information, credentials or access tokens, analytics data, business listings, and other materials needed to provide services. Credentials should be handled through approved secure methods and not requested through ordinary forms unless necessary.
Public and third-party business information may include professional profiles, public business records, website information, directory listings, reviews, social media information, referral information, and data supplied by business partners, service providers, or a person’s employer.
Inferences may include likely service interests, account needs, project priorities, or engagement patterns derived from the information above. Viper Digital does not use such inferences to make decisions producing legal or similarly significant effects unless separately disclosed and lawfully implemented.
3. Information We Process for Clients
Viper Digital may host, maintain, secure, optimize, or support client websites and related systems that collect visitor or lead information. This may include names, contact information, messages, appointment requests, form responses, website usage data, consent records, and other information configured by the client.
For this client-controlled information, the client is responsible for deciding what to collect, providing legally sufficient notices, identifying lawful purposes, configuring consent and preference tools, responding to consumer requests, setting retention requirements, and determining whether industry-specific or sensitive-data rules apply. Viper Digital processes the information only as needed to perform services, protect systems, follow documented client instructions, comply with law, and enforce the applicable agreement.
A separate data-processing agreement or addendum may be required when applicable law, a client’s industry, the type of data, or the nature of the processing requires additional terms. Viper Digital does not accept regulated or highly sensitive information for ordinary service processing unless expressly approved in a separate written agreement with appropriate legal and technical safeguards.
4. Sources of Information
We may receive personal information directly from the individual; from the individual’s employer, organization, or authorized representative; automatically through websites, cookies, logs, and similar technologies; from clients, referrals, partners, contractors, payment processors, hosting and technology providers; from public websites, business directories, social networks, and public records; and from information generated during our business relationship.
5. Why We Use Information
We may use personal information to respond to inquiries and provide proposals; authenticate users and administer relationships; deliver, host, maintain, secure, support, transfer, and improve websites and related services; process payments and maintain transaction records; communicate about projects, billing, changes, renewals, security, and support; personalize service and remember preferences; measure website and service performance; perform analytics, quality assurance, testing, troubleshooting, fraud prevention, and security monitoring; create and maintain business records; manage vendors, contractors, and professional advisers; market Viper Digital’s services where permitted; comply with legal obligations and lawful process; exercise or defend legal rights; investigate violations; and complete a merger, financing, sale, reorganization, or similar transaction.
We will not use personal information for a materially different purpose without providing any additional notice or choice required by applicable law.
6. Legal Bases Where Applicable
Where a law requires a legal basis, we may process personal information to perform or enter into a contract; for legitimate interests such as operating, securing, supporting, and improving the business; with consent; to comply with legal obligations; or to protect vital interests or legal rights. A person may withdraw consent where consent is the basis, but withdrawal does not affect processing already lawfully completed.
7. Cookies and Similar Technologies
We and our providers may use cookies, pixels, local storage, tags, scripts, software development kits, and similar technologies to operate the website, remember preferences, understand usage, protect systems, measure performance, and, if enabled, support advertising or attribution.
Strictly necessary technologies support functions such as security, network management, forms, authentication, and requested services. Preference technologies remember settings. Analytics technologies help us understand traffic and performance. Advertising technologies, if used, may measure campaigns or support interest-based advertising across services.
Before publication, Viper Digital must maintain a current cookie and tracker inventory naming the actual categories, purposes, providers, durations, and whether information is used for cross-context behavioral or targeted advertising. Where required, nonessential technologies must remain disabled until valid consent is obtained.
8. Analytics and Advertising Choices
Browser settings may allow a person to block or delete cookies, although some features may not function correctly. Where required, our website will provide a cookie-preference tool that permits choices by category and allows consent to be withdrawn as easily as it was given.
Viper Digital will honor legally required opt-out preference signals, including supported browser-based signals, when they apply to our processing. We will not ask a person to create an account solely to exercise a legally available opt-out.
9. Sale, Sharing, and Targeted Advertising
Viper Digital does not sell personal information for monetary consideration. However, some privacy laws define “sale,” “sharing,” or “targeted advertising” more broadly than an exchange for money. If Viper Digital uses analytics, advertising, audience, or attribution technologies that fall within those definitions, we will disclose the relevant categories and recipients and provide any required opt-out mechanism.
10. How We Disclose Information
We may disclose personal information to hosting, cloud, content-management, security, analytics, communications, customer-relationship-management, support, payment, scheduling, productivity, artificial-intelligence, and other service providers that perform functions for us; to employees, contractors, and affiliates who need the information for authorized work; to professional advisers such as attorneys, accountants, auditors, and insurers; to a client or the client’s authorized users when the information relates to that client’s website or engagement; to authorities or other parties when reasonably necessary to comply with law, respond to lawful process, protect rights and safety, investigate wrongdoing, or enforce agreements; and to participants in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of the business, subject to appropriate protections.
We may disclose aggregated or deidentified information that cannot reasonably be linked to an individual. We will not attempt to reidentify information maintained as deidentified except to test whether deidentification controls remain effective or as permitted by law.
11. Service Providers and Subprocessors
Viper Digital may use service providers and subprocessors to operate and deliver services. We select providers based on factors such as capability, reliability, security, privacy terms, scalability, and cost. Provider locations and practices may change as our systems evolve.
Where required, contracts will limit a provider’s use of personal information to authorized purposes and impose appropriate confidentiality, security, deletion, and assistance duties. Clients that require a current subprocessor list, advance-change notice, a data-processing addendum, or international-transfer terms must arrange those requirements in writing.
12. Artificial Intelligence and Automated Tools
Viper Digital may use artificial intelligence and automated tools to support research, drafting, design, image creation, optimization, categorization, quality assurance, or internal efficiency. We use human review appropriate to the task and do not intentionally submit regulated or highly sensitive personal information to general-purpose AI tools without separate approval and safeguards.
Information provided to an AI or automation provider may be processed under that provider’s contractual terms. Before using a tool with personal information, Viper Digital should evaluate data-use settings, retention, training controls, confidentiality, security, and available enterprise protections. We do not use solely automated processing to make decisions about individuals that produce legal or similarly significant effects unless separately disclosed and lawfully implemented.
13. Payment Processing
Payments may be processed by an independent payment provider. The provider may collect payment-card, bank, fraud-prevention, device, and transaction information under its own privacy notice. Viper Digital generally receives confirmation, transaction identifiers, limited card details, and billing status rather than full card credentials.
14. Communications and Marketing
We may send service, transaction, security, billing, and relationship communications that are necessary to administer an inquiry or engagement. We may also send marketing communications where permitted. A recipient may unsubscribe from marketing email using the link provided or by contacting us, but may still receive nonmarketing communications related to an active relationship.
We will obtain any consent required before sending marketing text messages or automated communications. Consent to marketing is not a condition of purchasing services unless lawfully stated otherwise. Message and data rates may apply. INTERNAL — Add final text-message program terms only if Viper Digital actually operates such a program.
15. Data Retention
We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, including providing services, maintaining business and tax records, resolving disputes, enforcing agreements, protecting security, honoring choices, and complying with legal obligations.
Retention varies by category and is based on the duration of the relationship; the sensitivity and volume of the information; operational need; contractual commitments; limitation periods; legal, accounting, tax, and insurance requirements; security needs; and whether deletion is technically feasible in backups. When information is no longer required, we delete, anonymize, or securely dispose of it in accordance with applicable procedures.
16. Data Security
We use reasonable administrative, technical, and organizational safeguards designed for the nature of the information and our operations. Measures may include access controls, least-privilege practices, multifactor authentication where available, encryption provided by applicable platforms, secure credential handling, logging, backups, updates, malware protection, vendor review, personnel confidentiality obligations, and incident-response procedures.
No system, transmission, or storage method is completely secure. Individuals and clients should use strong unique passwords, protect account credentials, limit authorized users, and notify us promptly of suspected unauthorized access.
17. Security Incidents
If we discover a security incident affecting personal information, we will investigate, contain, remediate, document, and provide notices or cooperation as required by applicable law and contract. When Viper Digital processes affected information for a client, we will notify and assist the client as required by the applicable agreement, and the client remains responsible for notices and decisions assigned to it by law unless otherwise agreed.
18. Sensitive and Regulated Information
Do not submit payment-card credentials, protected health information, Social Security numbers, government identifiers, biometric identifiers, precise geolocation, financial-account credentials, authentication secrets, children’s information, regulated educational records, or other highly sensitive or specially regulated information through ordinary website forms, support email, shared documents, analytics, or general-purpose AI tools unless Viper Digital has expressly approved the collection in a separate written agreement.
If sensitive information is processed where applicable law requires consent, we will obtain consent or provide another required mechanism before processing. Viper Digital may remove information, disable a form, suspend functionality, or require a separate compliance and security scope when restricted information is discovered.
19. Children’s Privacy
Viper Digital’s corporate website and services are directed to businesses and are not intended for children under 13. We do not knowingly collect personal information online from a child under 13 through our corporate website. If we learn that such information was collected, we will take reasonable steps to delete it, subject to legal obligations. A parent or guardian may contact us using the details below.
Clients must not configure a Viper Digital-managed website or service to target children or collect children’s personal information without prior written approval and a separate assessment of notice, consent, age-assurance, data-minimization, retention, and security requirements.
20. Your Privacy Rights
Depending on residence, relationship, and applicable law, a person may have rights to confirm whether we process personal information; access or obtain a copy; correct inaccuracies; delete information; obtain portable data; opt out of sale, sharing, targeted advertising, or certain profiling; limit or withdraw consent for sensitive information; appeal a denied request; and receive equal service without unlawful discrimination for exercising privacy rights.
Rights are not absolute. Exceptions may apply for information needed to complete a transaction, provide a requested service, protect security, comply with law, exercise legal rights, maintain records, or process information in a role exempt from a particular law, such as certain business-to-business or employment contexts.
21. How to Exercise Privacy Rights
Submit a request by emailing Legal@viperdigital.io. Describe the request and the relationship with Viper Digital. We may request information reasonably necessary to verify identity and authority while avoiding collection of unnecessary information.
An authorized agent may submit a request where permitted. We may require proof of authorization and may verify identity directly with the individual. We will respond within the period required by applicable law and explain any denial. If an appeal is available, submit it through Legal@viperdigital.io with “Privacy Appeal” in the subject line.
We ordinarily do not charge for a request, but may charge or decline requests when permitted by law, such as requests that are manifestly unfounded, excessive, repetitive, or technically disproportionate.
22. California and Other U.S. State Disclosures
If a comprehensive U.S. state privacy law applies to Viper Digital and the requesting individual, the categories described in Sections 2, 4, 5, 9, and 10 provide notice of the personal information collected, sources, purposes, and disclosure categories. We retain each category as described in Section 15 rather than for an arbitrary indefinite period.
During the preceding 12 months, Viper Digital may have collected and disclosed for business purposes the categories described in this Policy, depending on actual operations. Viper Digital does not use or disclose sensitive personal information for purposes requiring a right to limit unless the final data inventory identifies such use.
23. International Visitors and Data Transfers
Viper Digital is based in the United States, and information may be processed in the United States and other countries where providers or personnel operate. Those countries may have privacy laws different from the individual’s jurisdiction.
If Viper Digital becomes subject to an international privacy law requiring a transfer mechanism, representative, data-protection officer, or additional disclosures, Viper Digital will implement the required mechanism before covered processing. Clients requiring international data transfers or services directed to individuals outside the United States must disclose that need before launch so the parties can determine whether a separate agreement and technical configuration are required.
24. Third-Party Websites and Social Features
Our website and services may link to third-party websites, embedded content, maps, scheduling tools, videos, social networks, payment services, or other features. Those parties may collect information under their own notices. Viper Digital does not control their independent privacy or security practices. Individuals should review the applicable third-party notices before providing information.
25. Business Transfers
Personal information may be reviewed, transferred, or disclosed as part of due diligence or a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction. Any recipient will be subject to applicable law and the commitments that continue to apply to the information.
26. Changes to This Policy
We may update this Policy to reflect changes in law, technology, providers, services, or business practices. The updated version will identify its effective date. We will provide additional notice or obtain consent when required for a material change. Archived versions should be retained so Viper Digital can identify the policy applicable during a given period.
